En vista de las propuestas presentadas por Canadá y la UE, el FIIB propone:

1. Que se mantengan los párrafos 7, 8 y 9 en su versión original. Consideramos que las tareas (7,10 y 12) propuestas en el párrafo 7 son relevantes para los pueblos indígenas y comunidades locales y para el fortalecimiento del trabajo de GT sobre el Artículo 8(j). Tareas como las relacionadas a la elaboración de los elementos para el Sistema Sui Generis, el Código de Conducta, la repatriación de la información, incluyendo la relacionada a la propiedad cultural, son críticos para el cumplimiento de los objetivos del Convenio de Diversidad Biológica, y por lo tanto deben ser completados en el próximo Grupo de Trabajo de 8j.

2. Que se considera la propuesta de Canadá en ADICION al párrafos 7 y 8 pero NO en SUBSTITUCION a esos párrafos señalados.

3. El FIIB no acepta la propuesta de la UE

7. Decide comenzar la labor sobre las tareas 7, 10 y 12, teniendo en cuenta las contribuciones ya hechas para estas tareas por los sistemas sui generis y el código de ética y pide al Grupo de trabajo especial sobre el Artículo 8 j) y disposiciones conexas que inicie el trabajo sobre dichas tareas en su sexta reunión y comenzar la labor acerca de directrices sobre acceso a los recursos genéticos y conocimientos tradicionales asociados y participación justa y equitativa en los beneficios provenientes de su utilización; (Texto original)

7.bis Decide desarrollar una estrategia para la conservación y el uso sostenible consuetudinario de la biodiversidad por los pueblos indígenas y comunidades locales para empoderar y reforzar el rol de los pueblos indígenas y las comunidades locales, en el proceso de la toma de decisiones utilizando el enfoque de ecosistemas a nivel local, nacional e internacional. 8. Decide iniciar la tarea 15 del programa de trabajo del Artículo 8 j) y disposiciones conexas, a fin de elaborar directrices que facilitarían la repatriación de la información, incluyendo la propiedad cultural, de conformidad con el Artículo 17, párrafo 2, del Convenio sobre la Diversidad Biológica, con miras a facilitar la recuperación de los conocimientos tradicionales en materia de diversidad biológica; (Texto original)

8.bis . Invita a los Estados Partes, Pueblos Indígenas y Comunidades Locales y otras organizaciones relevantes, de proporcionar información sobre las buenas prácticas y experiencias del uso del conocimiento tradicional, innovaciones y prácticas en la toma de decisiones respecto a la conservación y el uso sostenible de la biodiversidad, igual como el manejo sostenible de recursos incluyendo en otros: (i) políticas gubernamentales relacionadas al acceso, uso y protección del conocimiento tradicional, innovaciones y practicas; (ii) obteniendo el consenso previo e informado; y (iii) metodologías para incluir el conocimiento tradicional en los estudios ambientales y pide al Secretariado Ejecutivo compilar esta información y hacerlo accesible al Grupo de Trabajo 8j para su consideración. 9. Invita a las Partes, Gobiernos y organizaciones internacionales, comunidades indígenas y locales y otras partes interesadas a que proporcionen a la Secretaría sus puntos de vista sobre las tareas a que se hace referencia en el párrafo 7 de la presente decisión, tomando en consideración el trabajo en curso relativo a los sistemas sui generis y el código de conducta ética y la relación de toda esta labor con la elaboración y las negociaciones en curso del régimen internacional sobre acceso y participación en los beneficios y pide al Secretario Ejecutivo que recopile dichos puntos de vista y los presente a la próxima reunión del Grupo de trabajo especial de composición abierta sobre el Artículo 8 j) y disposiciones conexas; (Texto original)

7. Decide desarrollar una estrategia para la conservación y uso sostenible, incluyendo el uso tradicional, de la biodiversidad por parte de los Pueblos Indígenas y Comunidades Locales con el fin de empoderar y fortalecer el rol de los Pueblos Indígenas y Comunidades Locales en la toma de decisiones sobre ecosistemas a nivel local, nacional e internacional.

8. Invita a las Partes, Pueblos Indígenas y Comunidades Locales, y otras organizaciones a informar de las buenas prácticas y experiencias en el uso del conocimiento tradicional, innovaciones y prácticas en la toma decisiones relacionadas con la conservación y uso sostenible de la biodiversidad, y el manejo sostenible de recursos, inter-alia: (i) políticas gubernamentales relacionadas al acceso, uso y protección del conocimiento tradicional, innovaciones y prácticas, (ii) obteniendo el consentimiento, previo, libre e informado, (iii) metodologías para incluir el conocimiento tradicional en los estudios ambientales. Solicita al Secretario Ejecutivo que compile esta información y hacerla disponible al GT8j para su consideración en el desarrollo de tal estrategia.

Intervención sobre Mecanismos Financieros

Gracias Sra. Presidenta,

Hablo en nombre del Foro Internacional indígena sobre Biodiversidad (FIIB) sobre la movilización de recursos financieros y el nuevo Plan Estrategico del GEF. Estamos muy preocupados por la estrategia de movilización de recursos y los elementos propuestos para la programación prioritaria del GEF para los años 2010–2014, que han sido elaborado sin participación significativa de los Pueblos Indígenas. También manifestamos nuestra profunda preocupación que el CDB está pidiendo financiación de mecanismos financieros tales como el Fondo de Adopción del FMAM y la Facilidad de Asociados de Carbono del Banco Mundial, que son fondos que potencialmente violan derechos humanos y particularmente derechos de los pueblos indígenas, y que estos dos mecanismos no tienen estándares adecuados para la protección de derechos humanos.

Por lo tanto Sra. Presidente, proponemos lo siguiente:

1. Que el COP proponga y apruebe el aumento del presupuesto bajo articulo 8j y disposiciones conexos para actividades en su plan de trabajo que pueden ser implementados por los Pueblos Indígenas, como actores activos y cruciales en la implementación del Plan de Trabajo del Grupo de Trabajo sobre 8j;

2. Que la estrategia 2010–2014 del GEF sea revisado con el fin de ser más coherente con los derechos e intereses de los Pueblos Indígenas;

3. Solicitamos que los Pueblos Indígenas participen activamente en las discusiones entre el CDB, el GEF y el Banco Mundial, para que los tipos de actividades a financiar sean coherente con los derechos humanos y derechos colectivos de los pueblos indígenas;

4. Proponemos que en el Plan Estratégico del GEF también incluya el establecimiento, con nuestra participación en el diseño, de un mecanismo de financiación directa a organizaciones de pueblos indígenas para proyectos que estén basados en nuestras propias prioridades y que serán ejecutados bajo nuestro manejo.

Gracias Sra. Presidenta y esperamos que podamos contribuir más a las discusiones siguientes sobre estos asuntos durante este COP.

Intervention on Financing Mechanisms

Thank you Madam Chair,

I speak on behalf of the International Indigenous Forum on Biodiversity (IIFB) on the issues of financial resource mobilization and the new Strategic Plan of the GEF. We are very concerned that the strategy for resource mobilization, and the proposed elements for the priority programming of the GEF for the years 2010–2014 have been developed without a significant participation of Indigenous Peoples. We also express our deep concern that the CBD is requesting financing from financial mechanisms such as the Adaptation Fund of the GEF and the Forest Carbon Partnership Facility of the World Bank, which are funds that potentially violate human rights and particularly the rights of Indigenous Peoples, and which have no adequate standards for the protection of human rights.

We therefore make the following recommendations:

1. That the COP proposes and approves an increase of the budget under article 8j and related articles for those activities in its Work Plan that can be implemented by Indigenous Peoples, as active and crucial actors in the implementation of the Work Plan of the Working Group on 8j;
2. That the strategy for 2010–2014 of the GEF be revised with the objective of being more coherent with the rights and interests of Indigenous Peoples;

3. We request that Indigenous Peoples participate actively in the discussions between the CBD, GEF and the World Bank, in order that the type of activities for which financing is sought, are coherent with human rights and particularly the collective rights of Indigenous Peoples;

4. We propose that the Strategic Plan of the GEF 2010–2014 also include the establishment, with our participation in such design, of a mechanism for direct financing to Indigenous Peoples’ organizations for projects that are based on our own priorities and will be implemented under our own management.

Thank you Madam Chair, and we hope to make further contributions to the following discussions about these topics during this COP.

International Indigenous Forum on Biodiversity (IIFB) Statement on Communication, Education and Public Awareness


Dear Madame Chair,

On behalf of the International Indigenous Forum on Biodiversity (IIFB), I am reading our comments on Agenda Item no 4.17 related to Communication, Education and Public Awareness (CEPA) documents no. UNEP/CBD/COP/9/25.

Communication and education has allowed us to accomplish an environment of peace, freedom, social justice, equity, full exercise of our rights for the sustainable use of the Biodiversity of indigenous peoples.

Since time immemorial, Indigenous Peoples have had the symbols and codes of communication. These have been tools which allowed the holistic development as individuals and collective beings.

In present time, communication and education are the ‘spine’ of our identity and global integration of Indigenous Peoples and this has allowed us to strengthen and apply the real labor of communication, education and sensitization society, for living in harmony with nature and the global society.

We call upon the Parties to implement the Program of Work and allow the full and effective participation of Indigenous Peoples in the work of CEPA as a key stakeholder in achieving the success of this PoW.

We acknowledge and appreciate the contributions of the EU on the recommendation of regional training on CEPA. However, we stress that these trainings should include the participation of Indigenous Peoples and Local Communities.

We again urge the parties to highlight and incorporate ‘the Central Role of the Indigenous Peoples and the Local Communities in the conservation and sustainable use of biodiversity’ as one of the key messages in the CEPA programme of work. All key messages should be translated, in collaboration with the Indigenous Peoples and Local Communities, into indigenous and local languages and broadcast/disseminate the same in community radio, media and include in the formal and non-formal education.

We support the proposal to celebrate 2010 as the International Year of Biodiversity. However, we once again urge the Parties to ensure the full and effective participation of the Indigenous Peoples and Local Communities in the celebration of the Year of Biodiversity.

We acknowledge the inclusion of the representative of the Indigenous Peoples in the Informal Advisory Committee (IAC) on CEPA and we look forward to a useful collaboration in future. The IIFB urges the implementation of Agenda for Action 2008/2010 in partnership with the Indigenous Peoples and Local Communities. It should be noted that Indigenous Peoples have organized themselves in order to work on implementation of CEPA programmes of work. The launching of the indigenous portal in 2007 which is available in four languages, in collaboration with the Indigenous ICT Task Force, and the initiative to formulate a CEPA Working Group are remarkable initiatives of the indigenous peoples in the implementation of CEPA programme of work.

We welcome all parties, civil societies, UN agencies and others to visit our portal at http://indigenousportal.com.

We urge parties, donors and international organization to support Indigenous Peoples’ initiatives in the implementation of CEPA’s programme of work.

The IIFB WG on CEPA went through the document UNEP/CBD/COP/9/25 and urge the Parties to include ‘parties’ in the draft decision 4 after the beginning word –invites. Henceforth the draft decision should be read as:
“Invites parties, interested donors and relevant international organization to provide adequate and predictable financial resources for implementation of the CEPA program of work.”

The IIFB also urges the parties to include the words “Indigenous Peoples and Local Communities (ILC)” in the draft decision no. 6. And it should be read as:
“Invites parties, Indigenous Peoples and Local Communities and relevant International Organizations to enhance the implementation at National level the program of work of CEPA and coordinate their efforts for the celebration of 2010 International Year on Biodiversity and submit their report to the Executive Secretary.”

Madame Chair, we would also like to comment on the draft decision no. 2 of UNEP/CBD/COP/9/25 Add.1. Here, we would like to remind the parties about COP 8 decision VIII/6 that the indigenous peoples’ and local communities’ representative have been included in the national advisory committees for the implementation of the CEPA programmes of work. Therefore, we like to suggest that the decision no. 2 should be read as:
“Encourages all parties to create national committees including Indigenous Peoples and Local Communities to celebrate the Year and invites all international organizations to mark this event;”

Punto de la Agenda: 4.9
Señora Presidente, en nombre del Foro Internacional Indígena sobre Biodiversidad, permíteme recordar a las Partes que la Declaración de la ONU sobre los Derechos de los Pueblos Indígenas fue aprobado por la Asamblea General el 13 de septiembre de 2007 y que los derechos consagrados en este instrumento deben facilitar y orientar las discusiones del CDB incluyendo aquellas sobre la biodiversidad marina y costera.

Señora Presidente, los Pueblos Indígenas han tenido muchas experiencias negativas con las áreas protegidas y, en muchos casos, las áreas protegidas han violado nuestros derechos fundamentales. Reafirmamos nuestra oposición al establecimiento de más áreas protegidas hasta que nuestros derechos a nuestros territorios, costas y mares están plenamente reconocidos y respetados. Para esta razón, proponemos que se quite el párrafo 16.

Señora Presidente, en cuanto a las áreas protegidas existentes en los territorios, costas y mares indígenas creadas sin nuestro consentimiento libre, previo e informado, hacemos un llamado por la restitución de estas áreas.

Señora Presidente, los criterios para establecer áreas protegidas mas allá de la jurisdicción nacional son solamente bio-geograficos y basados en criterios científicos que ignoran los sistemas indígenas de conocimientos tradicionales para el manejo de nuestra biodiversidad marina. Solicitamos que tanto esos criterios como el sistema eco-sistémico sean enriquecidos para incluir criterios sociales, culturales y espirituales. Nos preocupa que el anexo I (criterios científicos), anexo II (orientación científica) y anexo III (pasos) se basan solo en “un enfoque basado en ciencia.” Eso es inconsistente con las decisiones II/8 par. 1; IV/8 1B y V/6, par. 2 que adoptó el enfoque eco-sistémico como el marco para la implementación del análisis y los objetivos del Convenio.

Señora Presidente, los términos “mares abiertos” y mar profundo” no son claros y podría enredar o confundir las negociaciones aquí en la COP. Los Pueblos Indígenas tienen otra manera de comprender esos conceptos que los científicos. La definición de esos términos debe ser aclarado y los Pueblos Indígenas deben estar incluidos en el proceso de definición. La insuficiencia de estos términos perjudica en particular a los Pueblos Indígenas del Pacifico quienes viven en islas donde la plataforma continental es muy estrecha. Aplicar estas definiciones podría ser en detrimento a la seguridad alimentaría, la cultura y los derechos de los Pueblos Indígenas. En este sentido, los expertos de los Pueblos Indígenas deben estar incluidos en la elaboración de las definiciones de estos temas.
Por ultimo, los Pueblos Indígenas quisiéramos expresar nuestra oposición total a la “fertilización marina” propuesta por algunas partes y empresas. Hacemos un llamado por una moratoria inmediata sobre a “fertilización marina”.

En nombre Foro Internacional Indígena sobre Biodiversidad, queremos informarle nuestra recomendaciones con respecto al documento UNEP/CBD/COP/9/1/Add.2

Punto 4.9, referente a la Diversidad biológica marina y costera.

Parrafo11. [Adopta] [toma nota de] los criterios científicos, sociales y culturales para identificar las áreas marinas de importancia ecológica o biológica. que requieren protección incluidos en el anexo I de la presente recomendaciones [en aguas oceánicas abiertas y de aguas profundas,] [en zonas marinas fuera de la jurisdicción nacional] así como la orientación científica para designar redes representativas de áreas marinas protegidas incluida en el anexo II a la presente recomendación, según lo recomendó el taller de expertos sobre criterios ecológicos y sistemas de clarificación biogeográfica para áreas marinas que requieren protección.

STATEMENT ON BIODIVERSITY AND CLIMATE CHANGE

Madam Chairperson, I read this statement on behalf of the International Indigenous Forum on Biodiversity.

Climate change impacts on all of us, indigenous and non-indigenous. However, we are most severely affected due to our particular locations, our ways of life and our close relationship to the environment. It is not just our physical environment that is being threatened but our cultural survival as well.

It is therefore with great expectation that we endorse the efforts of the CBD to build greater cooperation with the other two Rio Conventions in search for a coordinated approach to the twin issues of biodiversity and climate change. In particular, we welcome the establishment of an ad hoc technical expert group on biodiversity and climate change. We recommend that the ad hoc technical expert group should have the issue of mitigation and adaptation mechanisms included in its mandate, and we urge the CBD to ensure the full and effective participation of indigenous peoples’ experts in this Ad Hoc –Technical Expert Group. The mandate must not only look at biodiversity risk assessments but also risks on biodiversity based livelihoods.

Madam Chairperson, we have time and again stated that we are victimized not only by climate change, but also by the adaptation and mitigation schemes being proposed and implemented without our full participation and understanding. These false solutions, such as CDM and REDD, are resulting in greater violations and threats to our rights and resources. We therefore demand that the Parties, the private sector and other actors ensure and guarantee the full recognition and respect for the rights of Indigenous Peoples as recognized in international instruments, especially those contained in the UN Declaration on the Rights of Indigenous Peoples for the design and implementation of whichever policy, project or schemes.

We also recommend the design and implementation of capacity building programs by and for indigenous peoples related to the issue of climate change in order for us to take informed positions and decisions, and we invite Parties and other entities to support our capacity building initiatives without any preconditions.

Finally, Madam Chair, we request that indigenous peoples can fully and effectively participate in the discussions that the CBD intends to have with the UNFCCC as well as other negotiations related to climate change. Additionally, we request the CBD to call upon the UNFCCC to allow for the full participation of indigenous peoples in its processes such as what exists within the CBD and the UNPFII. We remind Parties of their obligation to use the UN Declaration on the Rights of Indigenous Peoples as basis of negotiations and deliberations concerning biodiversity and climate change.
